Traditionally construction law services have been divided into new construction agreements and construction disputes. We are experienced in both. New construction agreements are the inception of your project. Here you would expect to develop a robust set of documents that tell you what you will get for the money you will be paying. There may be other documents for third parties such as your bank or a neighbour. These documents must be well thought through and be compatible with each other, or ‘back-to-back’ as it is sometimes put. Standard form documents are regularly used, although often amended. Most building work has a standard form building contract such as the JCT.
Construction is about building prototypes. This means there is a risk of unknown conditions perhaps within the foundations or during design development. Risk can incur costs and costs need to be allocated. Construction dispute law resolves issues about costs, delays and design problems. The construction industry has promoted the use of construction agreement settlement using adjudication, a quicker and cheaper but less exacting process than litigation or arbitration.
